Client Conduct Agreement

1. Purpose
This Client Conduct Agreement sets out the standards of behaviour, communication, and professional engagement that EyeKandy Co. expects from all clients. By engaging our services, you agree to abide by these standards throughout the duration of our professional relationship.
EyeKandy Co. is built on mutual respect and professionalism. We bring our absolute best to every project, and we expect the same level of commitment and respect from our clients in return.
2. Communication Standards
Clients agree to:
- Communicate professionally and respectfully at all times, whether in person, by phone, email, or social media
- Provide clear, timely responses to project-related communications within agreed timeframes
- Not engage in abusive, threatening, harassing, discriminatory, or defamatory language directed at EyeKandy Co. or its team members
- Raise concerns and feedback constructively and professionally
- Not contact EyeKandy Co. team members through personal channels without prior consent
3. Project Engagement
Clients agree to:
- Provide accurate, complete, and honest information when briefing us on projects
- Obtain all necessary legal permissions, location consents, model releases, and music licences before shoots
- Ensure that no illegal, harmful, or offensive content is involved in any project
- Not request EyeKandy Co. to produce content that infringes on third-party intellectual property rights
- Not misrepresent the scope, purpose, or intended use of a project
- Review and respond to drafts and deliverables within the agreed revision window
4. On-Location Conduct
4.1 During shoots and events, clients and their guests must behave in a safe and respectful manner at all times.
4.2 Clients must not interfere with or attempt to direct EyeKandy Co. crew in a manner that compromises safety or creative output. Creative direction should be communicated as part of the project briefing process.
4.3 EyeKandy Co. reserves the right to end a shoot immediately if any person at the location creates an unsafe, hostile, or inappropriate environment. In such cases, the deposit will be forfeited.
5. Payment Conduct
5.1 Clients must make payments honestly, on time, and via agreed payment methods.
5.2 Initiating fraudulent chargebacks or payment disputes without first attempting to resolve the matter directly with EyeKandy Co. will be treated as a breach of this agreement and may result in legal action.
5.3 Payment obligations are as outlined in our Terms & Conditions.
6. Confidentiality
Clients agree to keep confidential any sensitive business information, pricing strategies, creative processes, or proprietary methods shared by EyeKandy Co. during the course of the project.
7. Social Media & Public Conduct
7.1 Clients must not publicly disparage, misrepresent, or make false claims about EyeKandy Co. or its services on social media, review platforms, or any public forum.
7.2 Any disputes should be addressed directly and privately with EyeKandy Co. before being raised publicly.
8. Consequences of Breach
EyeKandy Co. reserves the right to immediately terminate any project or ongoing relationship with a client who breaches this Conduct Agreement. In the event of termination due to client misconduct:
- The client forfeits their deposit
- Payment for all completed work remains due and payable
- EyeKandy Co. is not obligated to deliver any outstanding work
- EyeKandy Co. may pursue legal remedies for any damages caused
9. Our Commitment to You
In return, EyeKandy Co. commits to treating every client with professionalism, honesty, and respect. We will communicate clearly, deliver quality work within agreed timeframes, and handle your project with the creative excellence and care you deserve.
10. Governing Law
This Conduct Agreement is governed by the laws of the Republic of Namibia and forms part of the overall agreement between EyeKandy Co. and the Client alongside our Terms & Conditions, Privacy Policy, and Media Usage Policy.
